Terms of Use

Welcome to Banner Sales (design). The following terms outline the rules that govern your use of this website (the "Site") and the purchase of our products and services. Your use of the Site constitutes your unconditional agreement to follow and be bound by these Terms and Conditions. We reserve the right to update, modify, change, or remove these Terms and Conditions at any time without prior notice. Your use of the Site following any such change constitutes your agreement to the changed terms, so we encourage you to review this page whenever you use the Site.

Payment

All prices and amounts shown on this Site are in U.S. Dollars (USD) and are subject to change at any time unless otherwise noted. When you place an order, you agree that all charges, taxes, and shipping and handling fees will be charged to your credit card or paid with an approved payment method. Every order must be paid in full, including shipping and handling, before we complete it. We will not begin working on an order until full payment is received.

Once an order has been submitted and sent to production, no changes are allowed. After an order has been sent to production, you are responsible for the entire amount of that order along with any applicable taxes and shipping and handling fees, unless we agree otherwise in writing.

Prices

Banner Sales (design) reserves the right to change or modify product pricing at any time with or without notice. Order acknowledgments, statements, quotes, and prices communicated in writing or orally may change at any time, including after acceptance of an order, as costs may change during manufacturing.

Return Policy

We want you to be satisfied with your order. Our full policy on refunds, exchanges, and reprints is published on the Return Policy page and is incorporated into these terms.

Shipping

Shipping options, production times, and transit times are described on the Shipping Information page. Production time and shipping transit time are separate: transit time begins when your order leaves our facility. We will use the carrier you choose on a best-effort basis, but may at our sole discretion choose an alternative method to deliver your order on time, more securely, or faster when it is reasonable to do so. Shipping times vary, and Banner Sales (design) assumes no responsibility for delays caused by carriers, weather, or other events beyond our control, or for any damages resulting from a late delivery. Our responsibility is limited to processing and preparing your order and providing it to the shipping carrier.

International Shipping: Customs, Duties, and Taxes

The recipient of an international shipment may be subject to customs brokerage fees, import duties, and taxes after the shipment reaches the destination country. These costs are not included in the item price or the shipping cost, and the recipient is responsible for them. Banner Sales (design) has no control over these government-imposed charges and cannot determine them in advance. Please contact your local customs office for information. Do not refuse a shipment or ignore carrier requests regarding duty or tax charges; we do not refund original shipping charges for goods refused at customs, and under no circumstances will Banner Sales (design) pay customs, duties, or taxes on your behalf.

Sales Tax

Banner Sales (design) charges sales tax on orders shipped to certain destinations. If you are tax exempt, email your tax exemption certificate to support@bannersalesco.com before placing your order.

Printed Color Accuracy

We reproduce color from submitted print-ready files as closely as possible, but cannot guarantee an exact match in color or density due to inherent limitations of the printing process. We accept no responsibility for color variations between submitted files and the final printed piece, and reprints are not honored for color variations that occur during printing.

Printed Order Turnaround Time

Printing turnaround time begins once your order has been placed, paid in full, and your artwork proof has been approved for printing. Turnaround options do not include shipping transit time. If a proof is approved after the daily production cut-off, the turnaround starts the next business day. In the rare event we fail to meet a promised deadline, the remedy is limited to a pro-rated refund of any rush charges or a courtesy rush on your next order. Orders may not be cancelled based on changes in production turnaround.

Artwork Files

We check artwork before printing, but you remain 100% responsible for the accuracy of your print-ready files. Please proofread all files carefully before submitting them. By submitting artwork you certify that you have the right to use the images it contains. You agree not to upload material that could give rise to civil or criminal liability or that infringes privacy, publicity, copyright, or other intellectual property rights without permission of the rights owner. Banner Sales (design) may require documentation proving you have permission to use the material, and reserves the right to refuse any order for any reason, including orders that are in our opinion illegal or infringe the rights of a third party. You accept full legal liability for the content of material processed and printed on your behalf.

Custom Tooling or Dies

All tooling, dies, equipment, drawings, technical know-how, and other preparatory items fabricated or procured by Banner Sales (design) remain our exclusive property, regardless of any preparation fee charged, and may not be used by the buyer without our prior written consent.

Printed Order Complaints

All complaints about a printed order must be received within 1 business day of delivery. If your order contains manufacturing defects or errors that are solely our responsibility (as determined by Banner Sales (design)), we will re-run the job at no charge.

Copyright

All content on this Site, including information, data, software, photographs, graphics, images, designs, icons, user interfaces, and other material, is intellectual property and copyrighted work of Banner Sales (design) and/or its providers. Reproduction or storage of content from this Site is subject to the U.S. Copyright Act of 1976, Title 17 of the United States Code.

Trademarks

The Banner Sales (design) name, logo, and all other marks appearing on this Site are trademarks of Banner Sales (design) in the United States and other jurisdictions. You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify these trademarks in any way without our prior written consent.

Restriction of Use

You may only use this Site to make legitimate requests to purchase the products or services offered, and you may not make speculative, false, or fraudulent requests. You may not use robots or other automated means to access this Site unless specifically permitted by Banner Sales (design). You represent that you are of sufficient legal age to create binding legal obligations for any liability you may incur from your use of this Site. Placing an order under a false name or with an invalid credit card is a violation of law, and fraudulent users may be prosecuted. Permission is granted to electronically copy and print portions of this Site solely for use as a shopping resource; any other use requires our prior written consent.

Privacy

You confirm that you have read, understood, and agree to the Banner Sales (design) Privacy Policy, the terms of which are incorporated here. If you are not a resident of the United States, note that personal information you submit to the Site will be transferred to and processed in the United States.

General Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BANNER SALES (DESIGN), INCLUDING ITS PAST, PRESENT, OR FUTURE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, OR AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, DAMAGE, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR CONNECTED WITH ANY USE OF THIS SITE OR ANY DELAY OR INABILITY TO USE THIS SITE, OR FOR ANY INFORMATION, PRODUCTS, OR SERVICES OBTAINED THROUGH THIS SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

If, notwithstanding the above, Banner Sales (design) is found liable for any loss or damage relating to the use of this Site, you agree that its liability shall in no event exceed the amount you paid to Banner Sales (design) for the order in question.

Indemnification

You agree to defend, indemnify, and hold harmless Banner Sales (design) and its affiliates from and against any and all claims, damages, costs, and expenses, including attorneys' fees, arising from or related to your use of the Site. You also certify that you own rights to, or have a license to use, any images reproduced as part of your printed order.

Orders Placed for Third Parties

If you use this Site to place orders for or on behalf of a third party, you are responsible for any error in the accuracy of the information provided, and you must inform the third party of all terms and conditions that apply to the products or services acquired. You agree to indemnify and hold Banner Sales (design) harmless from any liabilities, losses, damages, suits, and claims relating to your or the third party's failure to fulfill these obligations. You are directly responsible for any order submitted, including its fees, charges, and performance obligations.

Comments and Submissions

All comments, feedback, suggestions, and ideas submitted to Banner Sales (design) in connection with your use of this Site become and remain our exclusive property. They may be used in any medium and for any purpose worldwide without obtaining your specific consent, and we are under no obligation to keep them confidential, to compensate you for them, or to respond to them. You are solely responsible for the content of any comments you make.

Links to Third-Party Sites and Services

Where this Site links to outside services and resources, any concerns regarding them should be directed to the particular provider. Banner Sales (design) does not guarantee the accuracy or completeness of information on third-party websites, and those services are neither our employees nor our agents.

Discounts and Promotions

When promotions are offered, we communicate the explicit deal or discount and the time period in which it is valid. Unless otherwise specified, discounts expire at 11:59 PM EST on the stated expiration date. Promotions apply to orders shipped in the contiguous United States and may be limited to a specified dollar amount or percentage, stated where applicable. Order value for a discount is based on the published item total and does not include shipping, taxes, or other charges. Discounts are for online orders only and cannot be combined with other offers, coupons, wholesale or reseller pricing, or non-stocking items, and are not applicable to taxes or past orders.

Termination of Use

Your access to all or part of this Site may be terminated or suspended at any time, without notice and for any reason.

Miscellaneous

The captions in these Terms and Conditions are for convenience only and do not limit or define their terms and provisions. Banner Sales (design) is not responsible for errors or delays in responding to a request caused by an incorrect email address you provided or other technical problems beyond our control, and is not responsible for verifying that the shipping address entered with an order is accurate.

Entire Agreement

These Terms and Conditions, together with the Privacy Policy and the terms incorporated or referred to here, constitute the entire agreement between you and Banner Sales (design) relating to their subject matter, and supersede any prior understandings or agreements. If any provision of this agreement is found invalid, illegal, or unenforceable, the remaining provisions are not affected.

Governing Law

The internal laws of the State of New York govern these Terms and Conditions, without regard to conflicts of laws principles. You consent to the exclusive jurisdiction and venue of the courts located in Warren County, New York for all disputes arising out of or relating to these Terms and Conditions and your use of this Site.
